The Digital Creators Working Group (DCWG), a broad coalition of individual creators, small and independent producers, and large businesses representing virtually every aspect of the American creative sector, submitted its priorities for possible U.S.-UK trade agreement negotiations to the Office of the United States Trade Representatives (USTR). An impressive cadre of artists including Carole King, Carly Simon, Melissa Etheridge, Dionne Warwick, Mary Wilson (the Supremes), the Isley Brothers, John Densmore (the Doors), Judy Collins and many others recently added their names to a groundbreaking legal filing in California seeking compensation for pre-1972 recordings from digital radio services like SiriusXM and Pandora.

Currently, legacy artists enjoy no federal right to be paid by digital radio services for recordings made before 1972. Artists and record labels argue that some state laws, such as those in California, do provide protections for those pre-1972 recordings.  The artist listed above lent their names and voices to a powerful amicus filing in the case of Flo & Eddie (the Turtles) vs Pandora. Currently the California Supreme Court is considering whether or not a pre-’72 performance right exists in that state. The filing tells the story of California’s profound musical history and the artists that helped shape it, as told by the artists to veteran music journalist Steve Hochman (who penned the brief after many interviews). RIAA also filed a joint amicus brief in the case along with indie label trade association A2IM and indie label ABKCO.

Separately, the entire music community supports pending federal legislation, the CLASSICS Act, which would – once and for all – extend a federal performance right and compensation to those pre-1972 recordings.

Today, 20+ music organizations encompassing the entire music community sent this letter to U.S. Trade Representative Robert Lighthizer in response to a recent letter to the Ambassador from some tech giants who had claimed to be the “new faces of the American content industry.”  The USTR is currently renegotiating the NAFTA treaty with Mexico and Canada, and important copyright and intellectual property provisions are under discussion.  An excerpt of the music community’s letter is below:

In effect, those few tech associations are asking you to use trade agreements to prevent our Congress from legislating for the future. Just as some tech companies have changed from startups to global incumbents, the digital marketplace has also changed. Our trade agreements should also adapt, while not preventing our Congress from clarifying the original intent of U.S. law to the benefit of U.S. creators. It would be profoundly ironic, let alone fundamentally detrimental, to modernize NAFTA to include an outdated law that reflects a distant digital past, i.e., when NAFTA first entered into force.

We recently filed a comment with the Office of the United States Trade Representative (USTR) as part of its effort to develop negotiating objectives and positions for modernizing the North American Free Trade Agreement (NAFTA).  Notably, in our comments we urged USTR to oppose any provisions in any free trade agreement that would perpetuate the music industry’s “value gap,” which is “the biggest threat to the future sustainability of the music industry,” including the exportation of overbroad safe harbors which distort the music marketplace and lead to below-market rates for artists and creators.

One excerpt of our submission:

“According to one recent report, this safe harbor exemption acts as an enormous subsidy to the dominant incumbent video-streaming service [YouTube], a subsidy worth approximately $650 million to $1 billion annually. This company-specific industrial policy places one incumbent service at a fundamentally unfair advantage over other legitimate music services, which do not receive this enormous discount that was never intended by the legislative drafters, and instead negotiate commercial licenses with rights holders.”
